WITH RESPECT TO ANY ACCOMMODATIONS, NO CHANGE EXCEEDING 10% PER ANNUM IN THE MANNER IN WHICH POINT VALUES MAY BE USED MAY BE MADE WITHOUT THE ASSENT OF AT LEAST 25% OF THE VOTING POWER OF THE ASSOCIATION OTHER THAN THE DEVELOPER. NO BENEFICIARY WILL BE PREVENTED FROM USING THE TRUST PLAN AS A RESULT OF CHANGES IN THE MANNER IN WHICH POINT VALUES MAY BE USED. IN THE EVENT POINT VALUES ARE CHANGED, NO BENEFICIARY WILL BE PREVENTED FROM USING THE ACCOMMODATIONS IN THE SAME MANNER AS WAS PROVIDED FOR UNDER THE ORIGINAL PURCHASE CONTRACT.

Supply and demand limits: Your ability to secure an exchange is influenced by several factors, including supply of and demand for particular Units. The time that may be available is that which has been offered for exchange by Lion & Crown Members. Some Members prefer to keep the Unit they own for various reasons. When Members who own at a highly desired destination do not offer their time for exchange, there may not be enough availability to satisfy every exchange request. Please consult your Member Experience Manager for complete details, pricing, terms and conditions for all Experiences. Experiences are subject to change without notice. While great care has been taken to offer the finest Experiences, some Experiences may be provided by independent operators and The Ritz-Carlton Development Company, Inc., its officers, directors, members, partners, and all affiliates, subsidiaries and parent companies, will not be responsible or liable for any loss, damage, injury or costs resulting from, or in connection with, your use of independent operators. The Ritz-Carlton Club, Kapalua Bay, is not owned or developed by The Ritz-Carlton Hotel Company, L.L.C.
